Florida Seeks to Revoke Abortionist’s License After Felony Drug Convictions; He Goes into Marijuana Business

Tallahassee, FL – Operation Rescue has been informed by the Department of Health that a complaint it filed against abortionist James Scott Pendergraft IV has resulted in an Administrative Complaint that could result in the permanent revocation of his Florida medical license or other discipline.

The Administrative Complaint alleges that when Pendergraft pleaded guilty to ten felony charges of possession to distribute controlled substances in the State of South Carolina on October 16, 2017, he triggered a violation a Florida statute that states such a felony conviction is grounds for discipline in Florida.

Pendergraft was arrested on October 5, 2015, during a routine traffic stop near Spartanburg, South Carolina, after Sheriff’s Deputies found in his possession surgical implements that were covered in blood and human tissue from abortions he had illegally performed throughout South Carolina. He was also in the possession of illegal narcotics, such as marijuana, LSD, and drugs used to sedate women for abortions. Pendergraft held no medical license in South Carolina.

He was initially charged with five counts of illegal possession with intent to distribute. A grand jury later added an additional five counts.

In a letter to Cheryl Sullenger dated April 24, 2018, which accompanied a copy of the Administrative Complaint, she was advised that a Probable Cause Panel of the Department of Health found that probable cause exists to believe Pendergraft violated Florida statutes and qualified for disciplinary action. This determination was made after it reviewed her complaint along with the investigative report and the recommendation prepared by the Department of Health.

Pendergraft has had his Florida medical license suspended at least five times. It is currently under indefinite suspension, but that hasn’t stopped Pendergraft from profiting from his abortion businesses and illegal out-of-state abortion and drug operations.

Operation Rescue earlier reported that the Florida Department of Health has revoked the abortion facility licenses of four of Pendergraft’s abortion businesses based on his felony convictions in South Carolina.

Of those four, Pendergraft continued to operate two facilities either illegally or under questionable legality. After Operation Rescue reported that the Fort Lauderdale Women’s Center continued to do abortions illegally after its facility license was revoked and that a complaint was filed by Broward Right to Life, the facility finally shut down.

Now, ironically, Pendergraft has been converting some of his abortion facilities in marijuana distribution clinics — the very thing that earned him a felony conviction in South Carolina.

Michelle Herzog, an Orlando area pro-life activist, says that Pendergraft’s Fort Lauderdale location and his former Orlando EPOC abortion facility, both still owned by Pendergraft, are being converted to medicinal marijuana clinics under the name “Green Relief.” The website lists the physician at these marijuana clinics as Frank Rodriguez, who also currently serves as the primary abortionist at the Center of Orlando for Women and Women’s Center of Hyde Park, located in Tampa – both “former” Pendergraft abortion clinics.

The strong connections between the abortion businesses and medicinal marijuana clinics points to the very real possibility that Pendergraft is still in practical control of both businesses, which would be a violation of Board order for him to divest himself from the abortion businesses.

“We don’t want to see another license suspension for Pendergraft. He has proven that he has no respect for the law or the rules that apply to the practice of medicine in Florida. Repeated suspensions have done nothing to cause him to amend his ways. In fact, they have only made him more devious. This time, his license must be permanently revoked,” said Troy Newman, President of Operation Rescue.

Pendergraft has a long and sordid history of violations and malpractice cases.

Operation Rescue has caught Pendergraft operating outside the law before. He was ordered to cease and desist his illegal late-term abortion racket that he once conducted in Maryland, where he was unlicensed. His accomplice, abortionist Harold O. Alexander, had medical license was temporarily suspended as a result and later permanently revoked.

Operation Rescue also published a video taken by Herzog showing Pendergraft sneaking in the back door of his now-closed EPOC abortion mill in Orlando. According to Herzog, the waiting room was full of abortion patients and there was no other doctor present at the facility, leading her to believe he was about to commit abortions while he was prohibited from doing so by the Florida Medical Board. Herzog called the police, but Pendergraft bolted out the back door and fled the scene before police could arrive.

In 2011, Pendergraft was ordered to pay a judgment of nearly $37 million in a malpractice case that involved a horrific medication abortion inflicted on a woman who was 22.3 weeks into her pregnancy. Medication abortions of the type she received are not recommended after 7-9 weeks of pregnancy. She birthed an extremely premature infant, who survived with serious physical and developmental issues. Pendergraft has dodged efforts by that family to collect on the judgment.

He has also dodged paying over $120,000 in fines owed to the Florida Board of Medicine.

“Pendergraft richly deserves license revocation and to have all of his abortion facilities closed. However, he should be continually watched. He has proven that he is willing to go to any lengths and break any law to profit from killing babies. He simply cannot be trusted,” said Newman.

The disciplinary case will now move on to an administrative hearing where Pendergraft will be allowed a defense, or he could reach a consent agreement with the Medical Board.

Operation Rescue will continue to monitor the progress of Pendergraft’s disciplinary case.

Baby Parts Researcher Locked Out of Lab at UNM, Suspected of Selling Remains for Profit

Report contradicts NM AG’s claim no laws were broken

Albuquerque, NM – Since New Mexico Attorney General Hector Balderas released his findings in response to two criminal referrals from the House Investigative Panel on Infant Lives saying no laws against the trafficking of aborted baby remains were broken by the University of New Mexico or Southwestern Women’s Option, more information has surfaced that casts doubt on the accuracy of that determination.

Ironically, on Thursday, January 4, 2018, the front page of the Albuquerque Journal featured two contradictory stories. One was a report on Balderas’ “findings,” and the other was a report based on internal UNM documents obtained by the newspaper that revealed the UNM Health Sciences Center discovered that one of it’s researchers, Dr. Robin Ohls, was receiving aborted baby remains exclusively from Southwestern Women’s Options, then transferring them to a private laboratory in Michigan.

The discovery was made when Ohls asked for financial compensation to one of her assistants who packaged the remains for transport.

The Albuquerque Journal, referenced a memo written by Dr. Paul Roth, Chancellor of the UNM Health Sciences Center (UNM HSC), and Elsa Cole, a university attorney.

“HSC staff was concerned that: 1) an issue was being raised that would potentially infringe on the University’s policy to not buy or sell human tissue, and 2) appropriate research compliance approvals and processes protocols had not been followed,” the memo states. [Emphasis added]

Ohls was suspended from conducting research and was locked out of her laboratory by UNM HSC officials last October, 16 months after the first round of criminal referrals were made by the House Select Panel. It is believed by that UNM has halted all research using aborted baby remains, but that could not be independently verified by Operation Rescue.

UNM HSC is apparently conducting its own ongoing investigation into Ohl’s suspected profiting from the sale of aborted baby remains procured by her staff from Southwestern Women’s Options (SWO).

SWO is one of the few late-term abortion facilities in the country that openly commit abortions throughout all nine months of pregnancy. It is owned and operated by the elderly Texas abortionist Curtis Boyd, who admits to having engaged in illegal back-alley abortions prior to Roe v. Wade.

The destination of the tissue and organs obtained from SWO was a private company called Zietchick Research Institute, located in Plymouth, Michigan. It appears to employ one person, Dr. Tammy Movsas, and is funded through U.S. government awards totaling close to $2 million from 2014-2017, according to one government web site.

“Certainly, Balderas had access to this information at appears to have ignored in favor of marching in lock-step with his pro-abortion cronies in the Democratic Party. I guess his political career was more important to him than doing his sworn duty to uphold the law,” said Newman. “Fortunately, the Department of Justice has opened an active investigation into Planned Parenthood aborted baby body parts scheme, and are also investigating the UNM/SWO referrals, so there is still some hope that justice will be done.”

Michigan “Trunk Abortionist” Pleads No Contest to Three Felony Counts of Larceny

Detroit, MI – Abortionist Michael Arthur Roth, 75, appeared in a McComb County Circuit Court today and entered a plea of “No Contest” to three felony counts of Larceny in a Building.

The no contest pleas constitute felony convictions.

Activist Lynn Mills of Pro-Life Michigan was in the court room during the hearing and told Operation Rescue that Roth made a plea for leniency because he recently suffered a stroke.

Roth was criminally charged as the result of a car accident in 2015, when police discovered stolen drugs, abortion equipment, and aborted baby remains in his trunk. Roth had been secretly carrying out hazardous home abortions. He and an accomplice had stolen the instruments and drugs from an abortion facility owned by Angel Ojeda, who had employed Roth.

The incident earned him a nickname as the “Trunk Abortionist,” because he operated his illicit home abortion business out of the trunk of his car.

Roth’s Michigan medical license was suspended for one year, effective on October 13, 2017. He was also fined $25,000 for the “unlawful possession of a controlled substance” by the Michigan Medical Board.

Roth is due to be sentenced on December 7, 2017.

Bethesda, MD — This week, Nebraska late-term abortionist LeRoy Carhart plans to begin offering “advanced gestation” abortions at an illegal abortion facility, AbortionClinics.org, Inc., in Bethesda, Maryland. However, that opening, set for October 17, 2017, will be met with a strong and unified pro-life response.

A press conference and rally, sponsored by the Maryland Coalition for Life and a group of activists with the @StopCarhart coalition, will be held on opening day at noon on the sidewalk outside the new office located at 10401 Old Georgetown Road Suite 104, Bethesda, MD 20814. [Click for more info.]

Operation Rescue, which discovered the address of the secretive facility through an undercover investigation and verified that it has no license to conduct abortions, will provide a written statement to be read at the press conference.

Operation Rescue has since confirmed that Carhart’s new late-term abortion facility has no lab certification that would allow it to conduct routine lab testing, which is necessary for the kind of abortions late in pregnancy that Carhart plans to conduct there.

Operation Rescue has filed complaints with the Maryland Department of Health and Mental Hygiene and the Maryland Board of Physicians concerning the illegal abortion facility.

“We are praying that since Carhart’s plan to conduct illegal abortions at a secret facility in Maryland have been exposed, that he will think twice about opening up this week,” said Newman. “In the case he does open, we will be working hard to persuade the authorities to enforce Maryland laws.”

Las Vegas “YouTube Abortionist” Committed Suicide in Jail While Awaiting Trial

Las Vegas, NV – A man accused of committing illegal underground abortions without a license was found dead at the Clark County Detention Center where he was being held without bond pending trial.

Rick Van Thiel, 54, was found hanged in an apparent suicide on July 21, 2017.

Van Thiel was arrested and jailed in September, 2015, for conducting abortions and other quack medical treatments out of a grimy trailer in his junk-cluttered back yard. A local news reporter dubbed it the “Trailer of Terror.”

He was never formally educated, trained, or licensed in the field of medicine. His background was instead that of a pornographic movie star/maker and inventor of sex toys.

Van Thiel bragged during an interview from jail shortly after his arrest that he learned to do abortions by watching YouTube videos.

A Clark County grand jury issued 30 felony indictments against Van Thiel in June 2016, including:

• 19 counts of engaging as a medical physician without a license.
• 6 counts of sexual assault resulting in substantial bodily harm.
• 2 counts of sexual assault.
• 2 counts performance of a health care procedure resulting in substantial bodily harm.
• 1 count child abuse, neglect, or endangerment.

As a five-time convicted felon, Van Thiel was also charged with three federal firearms violations. A judge had ruled to suppress information about the firearms charges during his state trial, which was set for January 20, 2017.

Van Thiel was an opportunist. Like many charlatans before him, he saw that offering cut-rate abortions and quack “holistic” cures to hookers and other vulnerable women was a viable means to quick cash. He lured customers through several seedy “adult” websites and by word of mouth.

“It is a shame that Van Thiel took his own life. As long as he was living, there was hope for his redemption,” said Troy Newman, President of Operation Rescue. “However, he will never hurt another person again, and that is something to be grateful for, however tragic the circumstances might be.”

The arrest of Van Thiel came within weeks of news of two other illegal abortionists in two other states, raising concerns that underground abortions have become a dangerous new trend.

In October 2015, Michigan abortionist Michael Roth was involved in a traffic accident after which police discovered stolen drugs and surgical instruments, along with the remains of fourteen aborted babies, the result of his illegal underground home abortion scheme. He was later criminally charged and awaits trial in November 2017. On September 13, 2017, Michigan Medical Board suspended his medical license for 90 days and fined him $25,000.

Also in October 2015, Florida abortionist James Pendergraft was arrested in South Carolina for conducting abortions out of the back of his van and possessing illegal drugs. Pendergraft was never licensed to practice medicine in South Carolina. He was indicted by a grand jury in June 2016, on 10 criminal counts, and is set to stand trial on November 13, 2017.

“Before anyone thinks that a lack of access to abortion facilities had anything to do with this, all three of these men conducted illegal abortions in areas where there were several abortion facilities. This illegal abortion trend is all about exploiting the vulnerable to satisfy greed,” said Newman. “It is a thousand wonders that no mother was killed during these dangerous, unsanitary abortions. If anyone learns that there are underground abortions happening in their area, I urge them to immediately contact the local police.”
