Court Docs Hint at Proceedings in Late-Term Abortionist’s Malpractice Trial for Nightmare Botched Abortion

Denver, CO – Court proceedings are expected to resume today in a Federal malpractice trial against late-term abortionist Warren Hern that was brought by a Nebraska woman, who suffered horrendous injuries due to a nightmarish botched abortion in 2013.

Hern, who is nearly 80 years of age, is a nationally known late-term abortionist who operates the Boulder Abortion Clinic in Boulder, Colorado. He is one of the few abortionists that openly admit to conducting abortions throughout all nine months of pregnancy.

Operation Rescue was the first to report on the malpractice case on April 26, 2016, after obtaining court records that described a botched abortion horror story.

In 2013, Jennifer D. was pregnant with a wanted baby. However, after her pre-born son was diagnosed with “severe cerebral abnormalities” near the end of her second trimester of pregnancy, she was encouraged by her personal physician to get an abortion. She was referred to Hern’s Boulder Abortion Clinic.

After her dilation and evacuation (D&E) dismemberment abortion, which was done days away from her third trimester, Jennifer suffered complications that included break-through bleeding over the course of the next few months. Finally, she was taken into surgery to remove a foreign object that had been discovered cutting into her uterus. Unable to remove it, her doctor was forced to perform a hysterectomy.

When the object was finally analyzed, it was determined to be a four-centimeter slightly curved section of bone from her aborted baby’s skull. [Read the full report.]

The trial began on January 8, 2018, with jury selection in the Denver Federal Courtroom of Judge Phillip A. Brimmer. The process took all morning and into the early afternoon with a total of 21 jurors being excused for various reasons until, at last, nine citizens – 6 jurors and 3 alternates — were selected to sit on the jury and decide the case.

Plaintiff’s opening statements began shortly after 2:30 p.m., followed by the defense’s opening statements, according to courtroom minutes.

Jennifer’s complaint had accused Hern of failing to examine the baby’s remains to ensure the abortion was complete, and misrepresenting that he completed the abortion without performing adequate diagnostics that would have detected the skull fragment.

Hern’s defense, as expressed in other court records, is that Jennifer’s hysterectomy was unnecessary and the fault of her own physician. He argues his own follow-up care exceeded the standard of care.

To open the plaintiff’s case, Jennifer took the stand and testified for a half hour before court was recessed for the day.

On Day Two of the trial, Jennifer once again took the stand to testify for nearly an hour and a half, after which the judge excused the Jurors and conducted a “discussion” regarding decorum during witness examination. There was obviously some need for this discussion. Based on this writer’s experience in attendance at many hearings and trials, often such discussions comes as the result of overt reactions from observers in the gallery.

In fact, according to the courtroom minutes, after a recess, there was continued discussion regarding a member of Hern’s legal defense team, Amy Cook-Olson, who had interaction with a spectator. Such interaction is usually frowned upon by judges and earn a stern warning.

Jennifer was on the stand testifying the rest of the day. The subject of her testimony was not recorded in the court room minutes.

Day Three began on January 10, with Jennifer again taking the stand for another two hours of testimony.

“It’s very stressful to be grilled on the stand for the better part of three days, especially for someone who has to relive a trauma,” said Operation Rescue President Troy Newman, who is no stranger to a courtroom as a plaintiff, a defendant, and as an observer. “Jennifer was brave to endure that.”

Next up was a video deposition of Dr. Mark Carlson, the gynecologist who performed Jennifer’s surgery and ensuing hysterectomy. This video was played in lieu of live testimony. Later in the afternoon the testimony of Dr. Alan Torrell, a pathology specialist from Omaha, Nebraska, was heard through another videotaped deposition.

The day concluded with yet another video deposition of plaintiff’s witness Dr. Robert Arias, a psychologist from Lincoln, Nebraska, who specializes in neuropsychology and behavioral sciences.

While the details of these video depositions are unknown, court records offer hints as to where the plaintiff’s case is headed. A pathologist might well discuss the bone fragments removed from Jennifer’s uterus, while a psychologist would be qualified to discuss Jennifer’s mental condition, pain, and suffering that is alleged in her complaint.

Day 4 began with a discussion outside the presence of the jury concerning taking witnesses out of turn. Usually the plaintiff’s attorneys will present their full case, followed by the defense’s witnesses.

For whatever reason, next up was testimony of Warren Hern as presented in the form of another video deposition, which is unusual given that Hern was likely present in the courtroom. That video continued until the lunch break, after which plaintiff’s next witness Dr. Regan Theiler took the stand – this time, in person.

Theiler is a known abortionist who formerly served as Medical Director for Planned Parenthood of New Hampshire. She is currently employed at the Mayo Clinic in Rochester, Minnesota.

It is common in cases involving abortions to have someone who does them testify for the plaintiff. For example, during the Kermit Gosnell abortion/murder trial in 2013, a Planned Parenthood abortionist, Charles David Benjamin, testified for the prosecution against Gosnell and his horrific practices.

Theiler testified for the remainder of the day.

Jurors were dismissed and Judge Brimmer conducted a discussion about “confidentiality of upcoming witnesses,” which is perhaps a harbinger of what can be expected when the trial resumes on Tuesday, January 16, 2018 at 8:30 a.m. It is expected to conclude on Friday.

Operation Rescue will continue to closely follow this case, especially since reporting on it has been blacked out by Colorado media. The only coverage of this trial so far has been one brief story from a Nebraska newspaper, which was then covered by pro-life media outlets.

Pro-Lifers Make Strong Statement Against Unlicensed Late-Term Abortions in Bethesda

Bethesda, MD – A well-attended press conference and candlelight prayer vigil were held by pro-life activists at the Wildwood Medical Center in Bethesda, Maryland, where abortionist LeRoy Carhart had planned to conduct late-term abortions beginning yesterday.

Members of a number of groups and churches gathered to share their concerns that the facility was unlicensed and would be operating illegally. (Watch video from the press conference.)

However, after it was reported by Operation Rescue on Friday, October 13, 2017, that Carhart had not obtained an abortion facility license as required by law, his office cancelled all abortion appointments set for yesterday.

At the end of the press conference, Lauren Handy of Mercy Missions DC, announced that all abortion appointments were cancelled.

Chelsea Soulder, Carhart’s clinic administrator at his Bellevue abortion business, was at the Bethesda office yesterday where she denied that any abortion appointments were cancelled when asked by reporters.

However, Operation Rescue has proof on file obtained from an ongoing undercover investigation that abortion appointments were indeed cancelled, and that Carhart’s plans to abort babies of “advanced gestation” have been thwarted for now.

Local pro-life groups also leafleted other businesses and concerned pro-life supporters from around the nation called the Aubinoe Management Company, which manages the office building, and asked that they cancel Carhart’s lease. [Its number is (301)986-9070.]

“Every day that abortions do not take place in Bethesda is a victory,” said Operation Rescue President Troy Newman. “We pray Carhart’s new late-term abortion business never opens.”

Operation Rescue is grateful to all the wonderful people of Maryland and Washington D.C. who have worked tirelessly over the past few days to raise the alarm about Carhart’s illegal abortion plans. Those efforts will continue until Carhart is out of business in Maryland for good.

Carhart Cancels Abortions After Operation Rescue Exposed His Failure to Comply with Maryland Law

Bethesda, MD – Operation Rescue has confirmed that abortion appointments scheduled illegally for today at an unlicensed late-term abortion facility in Bethesda, Maryland, operated by abortionist LeRoy Carhart, have been cancelled.

The cancellations came after Operation Rescue discovered the location of his secret abortion facility in Bethesda through an undercover investigation, then confirmed that the facility had obtained failed to obtain an abortion facility license as required by Maryland law.

Operation Rescue also learned that many of the appointments set for today included abortions in the advanced stages of pregnancy. The abortions were to begin today and terminate later in the week.

“We have successfully prevented Carhart from opening his illegal abortion facility in Bethesda today as planned, but we have only won the first round of what we expect will be a tough fight to protect babies and their mothers from Carhart’s shoddy abortion practices,” said Troy Newman, President of Operation Rescue. “We pray this facility is never allowed to open.”

Complaints have already been filed against Carhart and his facility, AbortionClinics.org, Inc., with the Maryland Department of Health and Mental Hygiene and the Maryland Board of Physicians seeking enforcement of Maryland laws.

“There is no doubt that Carhart believes he can break the law without consequences. This time, he tried to pull a fast one and got caught,” said Newman. “We call on the Department of Health to permanently shut down his illegal abortion business. His attempt to conduct late-term abortions illegally is so egregious that we urge the Medical Board to revoke Carhart’s Maryland medical license permanently.”

Germantown Abortion Clinic to Close, but Will Carhart Open Another in Cahoots with the Window Well Abortionist?

The “Window Well Abortionist” has now been identified as Charlie Browne of Seattle, Washington.

Germantown, MD — News broke last week that Germantown Reproductive Health Services, a late-term abortion facility located in Germantown, Maryland, is being purchased by a pro-life group and must permanently close. Already the facility has stopped taking abortion appointments. Wednesday, August 30, 2017, is set to be the facility’s final abortion day.

The buyout deal, made with the Maryland Coalition for Life, also will shut down GRHS’s affiliated abortion facility, Prince George’s Reproductive Health Services, according to a posting on GRHS’s website, abortionpages.com.

However, late-term abortionist LeRoy Carhart, who began conducting abortions through all nine months of pregnancy as an independent contractor at GRHS in 2010, has vowed to continue his late-term abortion business in Maryland and is attempting to locate a new facility, according to a fundraising blog.

“Due to efforts made by anti-choice terrorists, they have been able to raise enough money to buy out the [GRHS] clinic. For a few years, Lee has been trying to purchase a clinic in Maryland that will not only provide gestationally advanced abortion care, but also training future providers,” stated Carhart’s fundraising page.

However, false and incendiary rhetoric aside, his efforts to raise money for the new clinic have been an abysmal failure, with only a little more than $2,000 pledged toward the $2 million goal.

Carhart, who is 76, actually resides in Nebraska and runs his own abortion facility in Bellevue, a suburb of Omaha, which conducts abortions up to 20 weeks of pregnancy. It would be impossible for him to operate a full-time late-term abortion facility in Maryland without help.

That’s where the “Window Well Abortionist” comes in.

Earlier this month, Operation Rescue reported on an African-American abortionist who was arriving at GRHS for his abortion shifts by climbing down a ladder into the window well and entering the facility through the window. At that time, his identity was a mystery.

Local activists have now identified him as Charlie Browne, 54, an abortionist who operates the All Women’s Health North abortion business in Seattle, Washington. Brown was spotted just this week at GRHS wearing a false beard.

It is the word on the street that Browne plans to go into business with Carhart in opening a new late-term abortion facility in Maryland – possibly at another location in Germantown.

With big money to be made conducting expensive late-term abortions, which can cost thousands of dollars, it is easy to see why Carhart and Browne don’t want to see this lucrative income stream dry up.

“Everything is very much up in the air at this point. However, Carhart is well known for making public promises he cannot keep. Much of what he says is just empty bravado for the sake of the gullible left-wing media,” said Troy Newman, President of Operation Rescue. “I’ll believe he has a new facility when I see it.”

For example, in 2009, Carhart was working at Women’s Health Care Services in Wichita, Kansas, which at that time was the largest late-term abortion facility outside Communist China. When that facility suddenly closed, he pledged to open his own late-term abortion facility within 25-50 miles of Wichita.

Carhart then told the media he planned to open a late-term abortion facility in Council Bluffs, Iowa, which also failed when the public flooded a City Council meeting in 2010 in opposition of his plans to kill babies throughout all nine months of pregnancy in their community.

Despite Carhart’s boasting, none of those plans ever materialized.

During his time at GRHS, there have been numerous medical emergencies, patient injuries, and even one patient death. Jennifer Morbelli died from complications to a 33-week abortion after Carhart had boarded a plane back to Nebraska. He was inaccessible to the family, who futilely attempted to contact him when Morbelli’s condition worsened. This delayed emergency medical care for Morbelli. The Maryland Board of Physicians ignored calls for disciplinary action.

“We pray that this unholy alliance between Carhart and Browne will never materialize and that there will be no replacement for Germantown Reproductive Health Services,” said Newman. “There has been more than enough human suffering there and it’s past time for it to end.”

Bizarre: Late-Term Abortionist Sneaks Down Ladder into Window Well to Enter Abortion Facility

Germantown, MD — As the notorious and aging abortionist LeRoy Carhart cuts back on his late-term abortion schedule at Germantown Reproductive Health Services, a mystery abortionist has been picking up the slack.

This man, who has yet to be identified, was caught recently in a video entering the abortion facility under police escort.

But that’s not the only way he has been seen entering the clinic.

Pro-life activists have seen him climbing down a ladder into the window well at the back of the office and entering through a window. This bizarre and unexplained behavior has been observed particularly on days that he comes in to do the grisly second and third trimester abortions.

Even more disturbing, local pro-life activists have told Operation Rescue that this abortionist does not use the same late-term abortion procedure as Carhart, who employs the Induction Abortion method developed by his former boss, George Tiller, of Wichita, Kansas.

The Induction method involves killing the baby in the womb with a drug called Digoxin, which is injected into the baby’s body. Afterwards, the woman’s labor is induced and she delivers her dead — but intact — child. The process can take 3-4 days.

However, the Window-Well Abortionist is said to use the Dilation and Evacuation method (D&E) on even the third trimester cases. Since he doesn’t use digoxin, this makes the aborted baby remains coveted by laboratories that engage in experimentation on fetal organs and tissues.

GRHS and LeRoy Carhart were investigated by the House Select Investigative Panel on Infant Lives, who were suspected of selling aborted baby remains. Could this be what is going on at GRHS today?

Needless to say, this dismembering of third-trimester babies also poses a much greater risk to women since bone fragments from such abortions have been known to cause serious injuries to the mother.

With the Window Well Abortionist’s identity unknown, there is no way to know his competency level with this dangerous procedure or what kind of disciplinary record he has.

Could previous discipline or even trouble with the law be what he is trying to hide?
