Wichita, KS – The trial of late-term abortionist George R. Tiller on 19 criminal misdemeanor counts of violating the unaffiliated physician requirement in the Kansas post-viability abortion ban has been delayed yet again. The new trial date, according to court records, has been reset to June 16 at 9:00 AM, raising concerns that the judge may be pandering to Tiller.
“People who are innocent usually want to get their cases over as soon as possible,” said Operation Rescue President Troy Newman. “People who are guilty want delay after delay, hoping to postpone inevitable punishment as long as possible. The old adage, ‘justice delayed is justice denied,’ couldn’t be truer.”
The charges were filed on June 28, 2007, by disgraced former Attorney General Paul Morrison, who refused to reinstate 30 more serious criminal counts filed by his predecessor, Phill Kline. Those 30 charges were dismissed by a judge who did not consider the evidence of the case.
A motion to dismiss the current case, filed by Tiller’s attorneys, was heard by Judge Clark Owens on November 2. Tiller is challenging the constitutionality of the law and is requesting a jury of twelve instead of the usual six member jury that the law prescribes for misdemeanor cases. Nearly five months later, Owens has yet to rule, causing a delay in the trial, previously set for March 10.
“The longer Judge Owens drags out Tiller’s criminal case, the more the public will continue to lose faith in the system’s ability to act,” said Newman. “There is very little faith left as it is.”
In a separate matter, a grand jury investigating Tiller has also been delayed pending oral arguments to be heard before the Kansas Supreme Court on April 8.
“Judge Owens’ continued stall tactics may be costing the lives of viable babies that continue to die at Tiller’s mill,” said Newman. “These delays are beginning to look like he is pandering to Tiller without concern for devastating consequences. If Owens can’t make a decision on motions and move the case forward in a timely manner, maybe he should recuse himself and let someone judge the case that can,” said Newman.

This is very disheartening as this is what they do so people will eventually forget about it. With all the efforts put forth to prosecute Tiller, it cannot stop here! Why is Kansas so intent on killing babies? Why aren’t the local citizens up in arms about this? Does Kansas run its own little “monarchy?” Where is justice? We must not allow this to be shoved under the rug! We can’t forget about these babies! Certainly there is more we can do!! Judge Clark Owens looks like some actor in a play who is just going through the motions. He doesn’t care! Dear God, give us the grace to sustain and the strength to go on in Your power and with Your Blessing! Thank you to Operation Rescue for your perserverance! God is on the side of those who work to spare the lives of His Children!
Many people do not realize that if this case with Tiller results in him being convicted, it’s going to start a huge war over Roe v Wade…worse than it already is at the present.
Too many political risks are involved here. Too many politicians, judges, etc. are being paid off to keep this case on hold. Money talks.
However, the more delays, the more press it gets. More people hear about it, and then the media is forced to deal with it…all of which is good.
Then, coincidentally, we get word of this Hodari maniac and the dead babies found in his dumpster. Then Belkis Gonzales and the live aborted baby being thrown on the roof to die.
More abortion stories are in the news now than ever before. The ugly secrets of the reality of the abortion industry are surfacing constantly…and more WILL surface. Unfortunately, in the meantime more innocent lives are lost.
God has a master plan for all of this, and the abortion industry is collapsing in on itself by it’s own doings. The evils of darkness are coming to light and justice will prevail in time.
Prayer is tantamount to the success of abolishing this atrocity against our children.
This country is finally seeing the reality of choice and is slowly but surely rejecting abortion…and it has the abortion gods in a state of panic.
The TRUTH will prevail.
Tiller will go down…and from there, others will as well.
The politicians, judges etc are more concerned with protecting their jobs than they are in doing what is right. Yes, they know if Tiller goes down, abortion rights will be affected and they don’t want to be the ones responsible because their careers are at stake. They are all a bunch of cowards. To have the power to do good and not to do it is a terrible sin, but they don’t care. Maybe someone of good character will step up to the challenge of prosecuting this one babykiller! Judge Clark Owens, we are watching to see if you have the courage to do what is right to stop Tiller from his huge baby masacre. People are losing faith in the system and with the large numbers of signatures against Tiller, how can Judge Owens not regard public opinion?
Eliot Spitzer thought he was above the law and look what happend. I think most politicians and judges are crooked. Gone are the days of doing what is right and good rather than what is best for one’s career, but we have to know that Jesus is with those who fight against this evil.
