Tiller Associate Cut Immunity Deal In Illegal Abortion Case

Reason to believe that Tiller and Neuhaus committed hundreds of violations of the law

Wichita, KS — Ann Kristen Neuhaus struck a deal for limited immunity with former Attorney General Phill Kline in exchange for her cooperation in his investigation against the notorious abortionist George R. Tiller. The current State Attorney General, Paul Morrison, is honoring the agreement in a case filed Thursday charging Tiller with 19 criminal counts based on abortion records obtained by Kline from a three-month period in 2003.

In exchange for immunity, Neuhaus gave statements under oath that spoke of her involvement in Tiller’s late-term abortion practice. According to Kansas law, two doctors who are financially and legally unaffiliated, must agree that a pregnant woman faces “substantial and irreversible impairment of a major bodily function” before an abortion after 21 weeks can be done. Neuhaus provided that second opinion for Tiller’s late-term abortions.

Operation Rescue first reported the Tiller/Neuhaus arrangement last August after being informed of it by a confidential source that participated in the grand jury investigation against Tiller in the 2005 death of late-term abortion patient Christin Gilbert.

Neuhaus has had no medical office of her own since 2002, when she closed her Lawrence abortion mill under financial pressure created by allegations that she had proceeded with an abortion on a woman who had withdrawn her consent. The Kansas State Board of Healing Arts declared in an emergency order that Neuhaus was a “danger to the public, an immediate threat, not limited to the likelihood of patient injury.”

“According to the grand jury source and our own investigations, the only way Neuhaus has access to patients is at Tiller’s invitation,” said Operation Rescue President Troy Newman.

“She travels to Wichita in one of Tiller’s old cars, she uses his office facilities, and she sees his patients. She signs a form and is paid via personal check from each patient. If Neuhaus doesn’t sign the form — and there is reason to believe that she did sign in every case — then Tiller cannot do the abortion. If Tiller does not invite Neuhaus to his office, she has no means of getting paid.”

“Tiller and Neuhaus had a symbiotic relationship in which neither of them could benefit financially without the other,” said Newman. “If this relationship was illegal in 2003, then it was also illegal in ’04, ’05, ’06, and ’07.”

“The 19 charges brought by Morrison are just the tip of the iceberg,” said Newman. “Tiller very likely violated this portion of the law hundreds of times. That does not even count the more serious phony mental health excuses behind the abortions that Morrison has refused to deal with. There is a lot more illegal activity going on at that clinic than is being reported, and we demand that additional records be inspected and additional charges be brought, for the sake of the innocent lives that should have legal protection in Kansas, but don’t.”

TILLER CHARGED WITH 19 CRIMINAL COUNTS

Wichita, KS — Attorney General Paul Morrison has announced that he is filing 19 misdemeanor charges against late-term abortionist George R. Tiller because he used a second physician that was not financially or legally unassociated with him, as required by law.

Operation Rescue has been reporting since August, 2006, that they suspected that Tiller’s association with Dr. Ann Kristen Neuhaus was an illegal one. Neuhaus was listed as a witness when Former Attorney General Phill Kline filed 30 criminal charges against Tiller last December. Those charges were dismissed on shaky jurisdictional grounds.

In his announcement, Morrison trivialized the murder of late-term children by calling the charges a “technical violations.”

“While we are happy that charges are being filed against Tiller, we are guarded about this because we believe that these charges are the weakest against Tiller. There is now a pattern of illegal activity by abortionist Tiller and Kline’s investigation is proven to have merit,” said Operation Rescue President Troy Newman.

“Now, because we have charges on the 2003 records, we insist that Morrison subpoena the 2004 and 2005 abortion records. Furthermore, in order for justice to be done, the criminal late-term abortion charges against Tiller, as supported by Psychiatrist Dr. Paul McHugh must be reinstated,” said Newman.

Kline filed 15 charges alleging illegal late-term abortion were committed by Tiller for reasons such as so a woman could go to a rock concert.

“We believe the filing of charges against Tiller vindicates Kline’s investigation of Tiller,” said Newman. “There is a pattern of abuses and illegal activity that is going on at Tiller’s mill. This is just the tip of the iceberg.”

Word on the illegal late-term abortion charges expected Thursday or Friday.

Topeka, KS — Attorney General Paul Morrison has announced that the 15 reporting charges filed by former Attorney General Phill Kline will not be pursued, characterizing them as “ridiculous.”

According to Morrison, Tiller could not be charged with criminal intent because he filled out the forms reporting late-term abortions the way that the Kansas Department of Health and Environment required them to be filled out.

“Attorney General Kline investigated Tiller and believed, from the evidence, that Tiller violated the law. A Shawnee County judge looked at the evidence and ruled that there was probable cause to believe that Tiller violated the law. A Sedgwick County judge and the Special Prosecutor came to the same conclusion after reviewing the evidence. One of the nation’s most accomplished and respected psychiatrists looked at the records and concluded that Tiller was violating the law. In fact, the only person to look at the records and determine that Tiller did not violate the law is Paul Morrison,” said Operation Rescue Senior Policy Advisor Cheryl Sullenger. “The reasons women are getting abortions — so they can go to rock concerts or so they will not wreck their tummy tucks — are not being reported as required by law. The laws are not being properly enforced at any level of government.”

“We are still awaiting Morrison’s decision on the charges of illegal late-term abortion. There is ample evidence in the public domain right now to get a conviction on that charge,” Sullenger said. “If Morrison lets Tiller off the hook on those counts, then he is the one who should be under investigation for corruption and obstruction of justice.”

Morrison announced yesterday that no charges would be filed against Planned Parenthood in Overland Park. That abortion clinic was under investigation for illegal abortions and concealment of child rape.
